First Safety RP
I had the privilege of joining PEI’s first safety RP meeting earlier this month. The membership should know that they are well represented by this very talented group of safety professionals from PEI member companies. Our discussion focused on recommended practices for fall protection (see more below.) Look for the fall protection RP at the 2022 PEI Convention at the NACS Show in Las Vegas.

Workforce Development
I’ve been reaching out personally to members on this front. The main theme? More qualified technicians. PEI’s solution? Use our vast array of training materials and industry knowledge to validate and credential our industry. The PEI staff is hard at work researching the best applications to support this important undertaking. Keep reading the TulsaLetter for updates.

PEI LAUNCHES CYBER LIABILITY INSURANCE OFFERING
PEI members can manage cyber risk and eliminate cybersecurity weaknesses through PEI’s partnership with insurance provider Monroe & Monroe. Similar to Monroe & Monroe’s liability pollution coverage for PEI members, the new cyber coverage offering is customized for the petroleum equipment industry’s needs and risk exposure. It is underwritten by Cowbell Insurance Agency.

Every business has a cyber risk. Common business activities such as email, phone communications, online payroll and accounting create cyber risk exposures. A recent PEI member survey shows more than half of PEI members lack cyber insurance. Nearly 73% said they are “somewhat confident” that their current security policies will prevent loss from a cyber threat. Cyber insurance means these companies can protect themselves against cyberattacks and lower the related financial risk.

In addition to customized coverage for first-party loss, first-party expenses, and third-party liability, PEI members may access risk insights and recommendations, continuous risk assessment, cybersecurity awareness training for employees, breach experts, and other security resources.

Coverage options include: security breach expense and liability; restoration of electronic data; extortion threats, public relations expense; hardware replacement costs; post breach remediation coverage; website media liability.

2022 PEI MEMBERSHIP RENEWALS

COMMITTEE BEGINS DEVELOPMENT ON PEI’S FIRST SAFETY RP
The PEI Safety Fall Protection Committee met Nov. 2-4 to begin work on PEI/SRP001: Safety Recommended Practices for Fall Protection and Working at Heights at Fueling Facilities. The document will be PEI’s first RP developed specifically on a safety topic. It is scheduled to be released in 2022. The guide will address:

  • Development and management of fall protection programs
  • Fall protection during excavation, UST and AST installation, service and maintenance
  • Use of fall protection devices and proper personal protective equipment
  • Ladder and lift safety
  • Roof and canopy work safety
  • Protection against slips, trips and falls
  • Regulatory compliance and liability reduction.

PEI SPANISH WEBINAR: AUTOMATION
On Nov. 18, PEI will offer a free webinar on fleet control and automation. The webinar is available exclusively to PEI members and will be conducted in Spanish. Pablo Gualdi, owner, president and CEO of ATIO Group in Mexico, will conduct the webinar. Gualdi has more than 25 years’ experience in the fuels sector. He leads the automation of more than 5,000 service stations in Mexico and commercial airports in Mexico, Colombia and Peru. The webinar will cover the processes in fleet control, including rules and restrictions. Gualdi will discuss the benefits and results of automating supply control and fleet management. UPDATED RP900 REFLECTS NEW INSPECTION PRACTICES
An updated PEI RP900:Recommended Practices for the Inspection and Maintenance of UST Systems will be available for purchase in December. The Environmental Protection Agency (EPA) recognizes RP900 as a code of practice that may be used to comply with walkthrough inspection requirements in 40 CFR 280.36 (a)(2). Among other things, the revised RP900 includes updated monthly and annual inspection requirements that mirror EPA requirements. The daily inspection requirement was removed and made optional, and the monthly inspection process was modified to reflect the removal of the daily inspection requirement.

POST-PANDEMIC FUTURE OF WORKER HEALTH AND SAFETY
Recordings are available from a three-webinar series “Exploring the Future of Worker Health and Safety in the Post-Pandemic World.” The series is from the National Institute for Occupational Safety and Health (NIOSH). It features perspectives on the future of worker safety, health, and well-being from organized labor, employer groups, and occupational, health and safety professional associations.

REGULATORY UPDATES
OSHA Releases Vaccine Rule; Court Temporarily Stays Mandate. On Nov. 4, the Occupational Safety and Health Administration (OSHA) issued an emergency temporary standard (ETS) requiring employers with more than 100 employees to enforce a mandatory COVID-19 vaccination requirement no later than Jan. 4, 2022, or implement a policy allowing for weekly testing. Two days later, a federal appeals court temporarily halted the vaccine mandate. The Biden administration has stated businesses should move forward with the requirements despite the court-ordered pause. The ETS does not apply to employees who do not report to a workplace where other individuals, such as coworkers or customers, are present, employees who work from home, or employees who work exclusively outdoors. More resources, including FAQs, sample templates, a summary of the ETS, and a fact sheet on workers’ rights are available on OSHA’s website.

OSHA Proposed Standards on Hazardous Heat Conditions. OSHA issued an advance notice of proposed rulemaking on heat injury and illness prevention in outdoor and indoor work settings. OSHA seeks information about heat-related issues it should consider in developing a standard, including the scope and application of the standard and what controls should be required. The agency wants to know about successful employer-led heat injury and illness prevention programs and controls. It also is interested in the potential impacts a federal heat standard would have on small entities. Comments are due Dec. 27, and may be submitted here.

NEWS BRIEFS
Michigan weights-and-measures inspectors found credit card skimmers inside pumps at eight gas stations during a recent routine inspection sweep. The station owners had used security measures, such as security tape, according to the state Department of Agriculture and Rural Development. None of the stations had chip card readers.

Seven Midwest governors sent a letter to EPA Administrator Michael Regan announcing they will explore all options, including requesting a new rulemaking, to ensure retailers may sell E15 to consumers in their states year-round without interruption. Earlier this year, a federal court vacated a June 2019 EPA rule allowing year-round sales of the fuel. The letter is signed by the governors of Nebraska, South Dakota, Iowa, Minnesota, North Dakota, Missouri and Wisconsin.

The U.S. will no longer apply tariffs on some steel and aluminum imports from Europe, and the EU will lift its retaliatory tariffs on U.S. goods. New tariffs were to be applied to U.S. goods starting Dec. 1, but those no longer will occur.

Tesla launched a non-Tesla Supercharger pilot at 10 Supercharger sites in the Netherlands. With this pilot, these stations are accessible to Dutch non-Tesla EV drivers via the Tesla app.

Tanknology recently received the Murphy USA Rising Star award for the development of the patent-pending TankCam. TankCam provides a detailed look inside fuel storage tanks to help find structural or lining problems, such as cracking, blistering, de-lamination or corrosion.

Tod Butler, senior advisor with Matrix Capital Markets Group, Inc. received the Society of Independent Gasoline Marketers of America (SIGMA) 2021 Distinguished Statesman Award for his contributions to the retail fuel marketing industry over the past 50 years. He is one of five people to receive the honor in the history of the association.

Dover Fueling Solutions opened a new production facility in Milan. The facility consolidates the ProGauge and Wayne Fueling Systems locations in Italy into one manufacturing and office space. All ProGauge automatic tank gauge (ATG) products — probes, consoles and 3D laser scan automatic tank calibration — are solely designed and manufactured at the new facility.
