PEI today opened a 30-day comment period on draft revisions to RP1200: Recommended Practices for the Testing and Verification of Spill, Overfill, Leak Detection and Secondary Containment Equipment at UST Facilities. The proposed revisions add low liquid level containment sump testing procedures to Chapter 6: Spill Bucket and Containment Sump Testing.

The 2015 federal underground storage tank (UST) regulations require vacuum, pressure or hydrostatic testing of containment sumps used for interstitial monitoring at least once every three years to ensure the sumps are liquid-tight. The U.S. Environmental Protection Agency (EPA) deems the hydrostatic testing method in Section 6.5 of RP1200 sufficient to meet this regulatory requirement. Under the RP1200 method, the owner or operator fills the sump with water to a depth of at least 4 inches above the sump’s highest penetration or sidewall seam. The sump passes the test if the water level drops by less than 1/8 (0.125) inch after 1 hour. If the water level drops 1/8 (0.125)  inch or more, the sump fails.

In November 2017, the EPA outlined a package of requirements for a low liquid level sump test method sufficient to meet its sump testing requirements. In June 2018, the EPA issued additional guidance on one procedure for conducting low liquid level tests.

The draft RP1200 low level liquid test procedure submitted for public comment requires:

• A liquid sensor configured to shut down the submersible turbine pump (STP) upon activation of the sensor;
• Stand-alone sensors that would shut down the appropriate dispensing device; or
• Mechanical float devices to shut down flow at the shear valve.

PEI expects to publish the revised document by the end of summer.

CALIFORNIA CLARIFIES UNDER-DISPENSER CONTAINMENT REQUIREMENTS
The California State Water Resources Board clarified on May 7 that unauthorized releases from product piping within a dispenser must be directed into secondary containment. All under-dispenser containment, including spill containment and control systems, also must comply with California secondary containment requirements.

Further, if an under-dispenser container, spill containment or control system could expose backfill material to an unauthorized release from dispenser product piping, a deflector plate must be installed to divert unauthorized releases into a monitored secondary containment. The State Water Resources Board will review all spill containment and control system devices to confirm compliance.

MAINE REJECTS E15 BAN
The Maine House of Representatives defeated a May 9 effort to override Gov. Janet Mills’ veto of legislation to ban the sale of motor vehicle fuels containing more than 10% ethanol.

A 2013 “contingent prohibition” of these blends remains on the books in Maine. Under that legislation, Maine would prohibit blends with more than 10% ethanol if at least two other New England states also ban the sale of such blends.

At present, no Maine retailers are selling E15. However, in a March 20 letter to Gov. Mills, Growth Energy stated, “Cumberland Farms, which has 43 locations in Maine, has committed to offering E15 at some of their store locations in the near future.”

DEATHS
Theodore “Ted” Reinke, 88, died April 29, 2019. A Korean War veteran and Lehigh University graduate, Reinke’s petroleum equipment industry career spanned more than 40 years. In 1976, he co-founded TR2 Corp. with his son Tom. He remained president of TR2 until his 1997 retirement. Survivors include three sons: Tom (Diane), Michael, and Jason (Alison); seven grandchildren; and three great grandchildren.
