Dear PEI Member: The National Conference on Weights and Measures (NCWM) held its interim meeting last week in Daytona Beach, Florida. A number of agenda items impact PEI members and their customers. Carryover items from last year included the sale of CNG/LNG, retail street price signage and diesel dispenser filter requirements. The street price sign item was withdrawn at the meeting but the other two will be voting items at the national meeting this July in Philadelphia. The CNG/LNG change seeks to add a diesel gallon equivalent (DGE) to the current gasoline gallon equivalent (GGE). The exact language to be voted on this summer is not yet available, but the gist is to measure the fuel in mass and allow either DGE or GGE to be shown on the dispenser. Weights and measures officials also will decide in July if they want to require 10-micron filters on retail diesel dispensers. Currently diesel dispensers require a 30-micron filter, while gasoline dispensers are required to use the 10-micron filter. The proposed change would include a waiver for dispensers that run at 15 gallons per minute or higher, like those used at truck stops. New business included a proposal to allow dispenser event logs to be delivered electronically rather than on paper. The exact language of the change to be voted on in July has yet to be determined. It’s our sense that weights and measures officials will not pass either the CNG/LNG measure or the 10-micron filter requirement when they vote in July. Passage of the electronic delivery of dispenser event log amendment depends on the exact language of the change. |

INDUSTRY NOTES MASSACHUSETTS AMENDS UST AND VAPOR RECOVERY RULES
Massachusetts also adopted a new underground storage tank (UST) regulation on January 2, 2015, that addresses design/construction/installation, registration, operation, maintenance and inspection of UST systems used to store petroleum fuels and hazardous substances. The regulation was developed to implement a 2009 law which transferred regulation of most aspects of the Commonwealth’s UST program from the Department of Fire Services (DFS) to MassDEP. Although the new regulation maintains the basic requirements established by DFS’s regulation, MassDEP has added new provisions that impact PEI members covering the inspection of installations; leak detection for piping; automatic line leak detectors for pressurized piping systems; turbine, intermediate and dispenser sumps; and spill buckets and overfill prevention equipment.
