The National Conference on Weights and Measures (NCWM) held its interim meeting last week in Daytona Beach, Florida. A number of agenda items impact PEI members and their customers.

Carryover items from last year included the sale of CNG/LNG, retail street price signage and diesel dispenser filter requirements. The street price sign item was withdrawn at the meeting but the other two will be voting items at the national meeting this July in Philadelphia.

The CNG/LNG change seeks to add a diesel gallon equivalent (DGE) to the current gasoline gallon equivalent (GGE). The exact language to be voted on this summer is not yet available, but the gist is to measure the fuel in mass and allow either DGE or GGE to be shown on the dispenser.

Weights and measures officials also will decide in July if they want to require 10-micron filters on retail diesel dispensers. Currently diesel dispensers require a 30-micron filter, while gasoline dispensers are required to use the 10-micron filter. The proposed change would include a waiver for dispensers that run at 15 gallons per minute or higher, like those used at truck stops.

New business included a proposal to allow dispenser event logs to be delivered electronically rather than on paper. The exact language of the change to be voted on in July has yet to be determined.

It’s our sense that weights and measures officials will not pass either the CNG/LNG measure or the 10-micron filter requirement when they vote in July. Passage of the electronic delivery of dispenser event log amendment depends on the exact language of the change.

REGISTRATION FOR PEI WOMEN CONFERENCE OPEN
Register now for the inaugural PEI Women Conference, to be held April 29 – May 1, 2015, in Denver, Colorado, at the Embassy Suites Downtown. The conference will be packed with exceptional educational sessions on both industry-specific and professional development topics. An optional tour of the National Renewable Energy Laboratory (NREL) is scheduled for the first day of the conference. Attendees also will have many opportunities to interact and network with other women throughout the conference.

Early-bird registration for PEI Women members is $395 ($495 for nonmembers) until February 25. After February 25, the fee increases to $495 for members ($595 for nonmembers).  The nonmember registration fee includes a PEI Women membership. Registration includes all sessions and materials, one lunch, two receptions and two dinners. The NREL tour is limited to the first 20 attendees who sign up and requires a $10 fee, which includes transportation to and from NREL. PEI’s room rate at the Embassy Suites is $150 plus tax. Breakfast is included with the hotel room rate.

INDUSTRY NOTES
Three Shell Oil Co. affiliates
have agreed to pay a $900,000 civil penalty to resolve alleged violations of the Clean Air Act at refining, distribution and retail facilities across the U.S.  Specifically, the EPA alleged that Shell sold fuel that was mislabeled as ultra-low sulfur diesel when it was actually low sulfur diesel fuel. The company also distributed about 700,000 gallons of gasoline from its Sewaren, New Jersey, terminal that contained elevated levels of ethanol, according to the agency. Shell also sold more than 4.2 million gallons of gasoline that exceeded a summertime fuel volatility standard, EPA said.
BMW and Volkswagen
announced a plan to build nearly 100 electric vehicle fast-charging stations on the east and west coasts of the U.S. The stations will be installed both within and between relevant metro areas, strategically spaced a maximum of 50 miles apart. More than 280,000 electric vehicles have been sold in the U.S.
Sheetz Convenience Stores will begin installing E15 dispensers at 60 of its stores in North Carolina during the early part of 2015. The dispensers should be installed at all 60 stations by spring 2016.
Representative Jim Sensenbrenner (R-MN) has revived his push for legislation that would require EPA to conduct further study on E15 fuel blends and their effect on engine performance. This is the third time Representative Sensenbrenner has introduced similar legislation. The other two times, the legislation cleared committee but was never considered by the full House.

MASSACHUSETTS AMENDS UST AND VAPOR RECOVERY RULES 
Effective January 2, 2015, amendments to MassDEP Air Pollution Control Regulations at 310 CMR 7.00 and 310 CMR 7.24 require the removal of Stage II vapor recovery systems and enhancements to Stage I vapor recovery equipment at gasoline dispensing facilities (GDFs) across Massachusetts. Under the new program requirements, GDFs must properly decommission existing Stage II systems according to PEI/RP300-09 within two years and phase-in California Air Resources Board Enhanced Vapor Recovery (CARB EVR) Stage I systems or EVR components within seven years. 

Massachusetts also adopted a new underground storage tank (UST) regulation on January 2, 2015, that addresses design/construction/installation, registration, operation, maintenance and inspection of UST systems used to store petroleum fuels and hazardous substances. The regulation was developed to implement a 2009 law which transferred regulation of most aspects of the Commonwealth’s UST program from the Department of Fire Services (DFS) to MassDEP. Although the new regulation maintains the basic requirements established by DFS’s regulation, MassDEP has added new provisions that impact PEI members covering the inspection of installations; leak detection for piping; automatic line leak detectors for pressurized piping systems; turbine, intermediate and dispenser sumps; and spill buckets and overfill prevention equipment.
