Dear PEI Member: The 24th National Tanks Conference was held last week
in Denver. Here is what we heard and learned. New federal underground
storage tank (UST) rule delayed until spring 2014. The new federal UST
rules are delayed again. EPA's Office of Underground Storage Tanks (OUST)
estimates it will take until next spring to review and respond to all of the
comments received on the rule it proposed November 18, 2011. Although we
heard several specific dates when the rule is expected to be finalized―April
15, May 1 and May 15―everyone we talked with at OUST thinks the "spring"
target date is reasonable and provides for unexpected delays in the process.
Release detection at high-throughput UST systems. UST owners and
operators typically encounter special challenges in complying with federal
release detection requirements for high-throughput systems. The primary
issue for release detection compliance at a high-throughput UST system is
the lack of quiet time, which is necessary for many release detection tests.
OUST has prepared draft guidance for release detection at high-throughput
UST systems entitled
Release Detection At High-Throughput UST Systems:
Practical Help and Guidance. OUST is seeking additional background
information, reports, studies and comments on any of the issues discussed in
the guide. Please provide that information to Tim Smith at
smith.timr@epa.gov by December 2.
Older UST systems may be nearing the end of their useful lives. Some
forward-thinking gasoline marketers have already initiated programs to close
or replace UST systems before they leak. These UST owners are using such
factors as age of equipment, warranties, type of construction (single-walled
or double-walled), site leak history, site ownership and profitability,
available funds and soil conditions to prioritize which UST systems will be
replaced and in what order. The marketers that we talked to are beginning
their voluntary replacement programs on UST systems installed in the 1970s
and early 1980s. What we heard from marketers in Denver was reminiscent of
the tank replacement programs undertaken by the major oil companies in the
1980s. New releases from regulated UST systems continue to decline.
EPA reports 2,974 new confirmed releases among the 581,097 active
USTs regulated by EPA's UST program in the first six months of the current
fiscal year. Compared to 9,000 new releases at mid fiscal year 2003 and
3,294 new releases at mid fiscal year 2008, the underground storage tank
program in the United States has made great strides in reducing the number
of releases into the environment. To view these numbers from another
perspective and to understand how far we have come as a nation, 510,733
releases have been reported since the beginning of the UST program.

DOE PUBLISHES ETHANOL EQUIPMENT HANDBOOK
Handbook for Handling, Storing and Dispensing E85 and Other
Ethanol-Gasoline Blends is the title of a
39-page report prepared by the National Renewable Energy Laboratory
(NREL), a national laboratory of the U.S. Department of Energy, Office of
Energy Efficiency and Renewable Energy. The document serves as a guide for
blenders, distributors, sellers, and users of E85 and other ethanol blends
above E10. It provides basic information on the proper and safe use of E85
and other ethanol blends, and includes supporting technical and policy
references. We read the handbook and believe it is a good reference document
for PEI members, as well. PETROLEUM MARKETER NEWS
Albertson's LLC, Boise, Idaho, is acquiring United Supermarkets LLC
dba The United Family, Lubbock, Texas, which operates 50 retail stores,
including seven convenience stores and 26 fuel centers.
"We certainly see the role of natural gas in our energy future, and
we are looking forward to participating as it evolves as a viable
alternative transportation fuel. We plan to evaluate the results of our
pilot project in West Texas, and if it is successful, we expect to gradually
roll out CNG fueling capabilities in other Stripes markets."―Steven

Lehigh Gas Partners LP and Lehigh Gas - Ohio LLC have
purchased 17 convenience stores in eastern Tennessee and southwestern
Virginia from Rogers Petroleum Inc.
