Dear PEI Member: The U.S. Environmental Protection Agency (EPA) is
seeking input through May 24, 2013, on its draft
Guidance For Addressing Petroleum Vapor Intrusion At Leaking Underground
Storage Tank Sites. If your company is directly or indirectly involved in the cleanup and
remediation of petroleum hydrocarbon (PHC) releases, you should
become familiar with EPA's proposed guidance and, if appropriate, offer
comments to the Agency. Vapor intrusion occurs when
vapor-phase contaminants migrate from subsurface sources into buildings. One
type of vapor intrusion is petroleum vapor intrusion (PVI), in which vapors
from PHCs such as gasoline, diesel, or jet fuel enter a building. The
intrusion of contaminant vapors into indoor spaces is of concern due to the
potential threats to safety (e.g., explosive concentrations of petroleum
vapors or methane) and possible adverse health effects from inhalation
exposure to toxic chemicals (e.g., exposure to benzene from gasoline). The
EPA draft guidance was prepared in response to a report issued by EPA's
Office of Inspector General in 2009, which recommended that EPA issue final PVI guidance on how to address risks from
PHC vapors at
petroleum underground storage tank (UST) sites where there has been a release.
At any leaking UST site, the draft guidance recognizes the importance of
having a thorough understanding of the release (i.e., source,
composition, and magnitude) and other factors that may influence the
distribution and transport of contaminants and/or that impact human safety and
health. EPA concluded that assessing the potential for PVI is "an integral
part of the normal response to a suspected or confirmed release from a
regulated UST system." To do this, EPA's Office of Underground
Storage Tanks (OUST) recommends in the draft guidance the following actions
when the authority having jurisdiction and/or the UST owner
and operator undertake release investigation and corrective action:
- Assess and mitigate immediate threats to safety
- Conduct a site characterization and develop a conceptual site model
- Delineate a lateral inclusion zone
- Identify preferential transport pathways within the inclusion zone
- Determine vertical separation distances from each building within the
inclusion zone
- Mitigate PVI, as appropriate

PEI'S RECOMMENDED PRACTICES ON AST INSTALLATION REVISED
The sixth edition of PEI's Recommended Practices for Installation of
Aboveground Storage Systems for Motor-Vehicle Fueling (PEI/RP200-13) is now
available from PEI. The 2013 edition supersedes and replaces the 2008
edition of RP200. PEI's AST Installation manual was first written in 1990 in
response to the environmental considerations and emerging technology that
prompted state governments to permit―and the industry
to use―aboveground tanks to store motor-vehicle fuel at refueling
sites. |

The 43-page manual provides a concise reference to
preferred practices and procedures for the installation of aboveground
storage tank systems at service stations and other fueling sites. These
recommended practices apply to aboveground, stationary, shop-fabricated
tanks and associated piping and equipment intended to dispense gasoline,
diesel and related fluids into motor vehicles at commercial and retail
service stations and marinas. These recommended practices may be applied to
horizontal and vertical tanks, single- and double-walled tanks, as well as
insulated, fire resistant and protected tanks.
Comparing this version of RP200 with the 2008
edition, users of the 2013 edition will note that it:
- Updates references to UL 142 tanks
- Deletes all references to UL 2244 tanks since the
listing was withdrawn by UL in 2008
- Revises section 6.2.2 on UL performance
testing
- Corrects a hydrostatic precision test pressure
value
- Updates Appendix C, which compares the 2012
aboveground storage tank code requirements of the National Fire Protection
Association with that of the 2012 International Fire Code
- Makes editorial changes to improve the
readability of the document.

ALTERNATIVE FUELS
Diesel fuel sold in Argentina will include a larger proportion of
biodiesel, the Argentinian government decided this month as part of its push to
conserve gasoline after the country's main refinery was damaged by fire in
early April. By June 1, diesel sold at Argentinian gas stations will include
10 percent biodiesel, up from the current 7 percent.
Hearings will be held this summer to examine the Renewable Fuel Standard,
a law mandating the blending of renewable fuels into petroleum-based fuels.
The hearings will be held by the Energy and Commerce Committee chaired by
Congressman Fred Upton, R-Mich. No date has been set for the hearings.

Florida has closed about 6,000 leaking petroleum storage tank cases
since the state's UST cleanup program began in 1986. Currently, there are 6,907 cases awaiting
cleanup, more than 3,600 where the cleanup has begun, and about 8,000 that
are not eligible for state funding and are being cleaned up by private

National retail fuel margins for regular unleaded gasoline jumped 51
percent year over year for the five-week period that ended April 1, 2013.―Raymond

Valero Energy Corp., San Antonio, Texas, has essentially exited the
retail gasoline market by spinning off CST Brands Inc., which includes
Corner Store and Depanneur de Coin. CST operates nearly 1,900 locations
throughout the southwestern United States and eastern Canada.
7-Eleven Inc., Dallas, Texas, has put 139 retail sites up for sale,
with the majority in Texas (83) and Florida (31).
Ryko Solutions, Inc., Grimes, Iowa, has acquired MacNeil Wash
Systems, Ltd., of Barrie, Ontario. The MacNeil brand name will remain
intact, as will the company's manufacturing facilities in Canada. MacNeil
will operate as a subsidiary of Ryko Solutions with Vince MacNeil, former
CEO of MacNeil, joining the Ryko board of directors.
ATTEMPTED ROBBERY AT NOZZLE POINT
A man was arrested earlier this month at a Shell station in Sarasota,
Florida, and charged with three counts of attempted robbery. The three
victims say that the man approached them at a gasoline dispenser, grabbed
the nozzle out of the dispenser boot and aimed it at them, telling them to
"give me everything you have" and threatened to injure them. The victims
refused to give the man anything and he walked away toward a nearby
apartment building. He was later taken into custody.
STAGE II VAPOR RECOVERY UPDATE
About 40 percent of all active stations in the St. Louis, Missouri,
area have applied for permits to decommission their Stage II vapor recovery systems.
Stations have been eligible to apply to decommission Stage II since March 15
in Franklin, St. Louis, St. Charles and Jefferson counties and the City of
St. Louis.
The New Jersey Department of Environmental Protection last week told
the Petroleum Equipment Contractors Association of New Jersey that the state
"currently has no plans to remove the Stage II vapor recovery requirement in
the state" and "expects Stage II to be around in New Jersey for a long
time."
The Ohio Environmental Protection Agency has issued a new Stage II
vapor recovery regulation that became effective April 29. The rule provides
that Stage II vapor recovery is no longer required at:
- any new gasoline dispensing facility (GDF);
- a GDF undergoing such a comprehensive renovation that it is as good as
new; and
- formerly exempt GDFs that have crossed the monthly throughput
threshold and have lost their exemption.
Ohio is still working on regulations governing the decommissioning of
Stage II vapor recovery. The rule issued April 29 does not allow existing
GDFs which are not undergoing comprehensive renovation to remove Stage II
vapor recovery.
