COURT DENIES CHALLENGE TO EPA E15 RULING
The full U.S. Court of Appeals for the District of Columbia (DC Circuit) said January 15 that it would not reconsider an August decision by a three-judge panel of the court that tossed out a key challenge to the Environmental Protection Agency's approval of gasoline blends containing 15 percent ethanol. The opinion rejects an appeal filed by trade groups representing the food, engine and oil industries, including the American Petroleum Institute. The DC Circuit ruled in August that the groups had no standing to bring the lawsuit.

REGULATORY BRIEFS
Maine.
The Maine Department of Environmental Protection is working on a bill to ban gasoline blends made up of more than 10 percent ethanol, provided at least two other New England states go along with the prohibition. According to press reports, the legislation is not yet written and the Department is still working on the final details.
Missouri. The Missouri Department of Natural Resources' Air Pollution Control Program issued a policy memorandum January 8 that will allow gasoline dispensing facilities to start decommissioning their Stage II vapor recovery systems beginning March 15, 2013. The Department is utilizing enforcement discretion in allowing decommissioning prior to making regulatory changes to its vapor recovery regulations and official approval of the necessary documentation by EPA. The Department intends to hold a stakeholder meeting in the St. Louis area in February to discuss potential changes to its regulations, as well as answer questions and provide further guidance on procedures for Stage II removal. The policy memorandum requires that a gasoline dispensing facility decommission its entire existing Stage II system in accordance with all applicable steps in PEI's Recommended Practices for Installation and Testing of Vapor Recovery Systems at Vehicle-Fueling Sites (PEI/RP300-09)  

EPA: DIESEL FUEL SULFUR CONTENT OF 500 PPM OK FOR OLDER TRAIN, MARINE ENGINES
The Environmental Protection Agency will allow the petroleum industry to continue producing diesel fuel containing up to 500 parts per million sulfur for use in older locomotive and marine engines beyond 2014, according to a final rule EPA signed December 14. The 500 ppm fuel must be used in older locomotive and marine engines that do not require 15 ppm sulfur diesel fuel, EPA said. The use of 500 ppm fuel will be phased out as the older locomotive and marine fleet turns over and is replaced with equipment that requires the use of ultra low sulfur diesel fuel.
