ENGINE AND AUTO GROUPS JOIN SUITS OVER EPA'S  E15 DECISION
The Engine Products Group (EPG)―a newly formed coalition of four engine and automobile manufacturing groups―has filed a lawsuit in the U.S. Court of Appeals for the District of Columbia Circuit challenging EPA's partial approval for the sale of gasoline containing up to 15 percent ethanol (E15). This suit comes weeks after lawsuits were filed by several food and petroleum industry organizations challenging the partial approval. According to EPG's press release, the petition challenges the ability of EPA to grant a partial waiver for three specific reasons:

  • The Clean Air Act does not authorize EPA to issue any partial waiver decisions,

  • The 2007 Energy Act prohibits the sale of fuel that could cause engine failure, increase emissions or other problems, and

  • The testing upon which EPA made its decision was put in the administrative record too late to permit meaningful comment or scrutiny from concerned groups and stakeholders.

According to the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety (BMU), E10 will have a decreased impact on the environment in terms of carbon emissions and will reduce consumer reliance on diminishing oil reserves. The BMU estimates that around 90 percent of existing cars in Germany will be E10-compatible. Vehicles unable to run on E10 can continue to use E5 until it is phased out in 2013.
