Last month at its annual meeting in St. Paul, Minnesota, the National
Conference on Weights and Measures (NCWM) discussed a number of issues that
might affect our industry sometime down the road. One issue is now in the
hands of the newly formed Retail Motor Fuel Dispenser Price Posting and Computing
Capability National Workgroup.The NCWM formed the workgroup to consider
changes to weights and measures regulations that affect the manner in which
fuel retailers are required to post prices and process fuel purchase discounts. The
primary focus will be centered around rebates, discounts for cash, car wash
purchases, loyalty cards and other discount scenarios.
When the current regulations in Handbook 44 were written, the discounting practices of retailers were relatively simple.
However, current advancements in retail fuel marketing have led to conflicts
with the regulations. The workgroup is charged with "preparing a proposal
for consideration by the NCWM to address any needed changes to the
handbook to ensure that the needs of all stakeholders continue to be met in
the modern retail fuel marketplace."
To accomplish its goal, the workgroup is expected to take these immediate
steps:
- Meet in mid-August to begin development of its work plan;
- Develop a timeline for completing its task and submit that to the
Specifications and Tolerances Committee for approval;
- Seek input from all stakeholders who should be part of this effort;
and
- Obtain examples of current marketing practices that may conflict with or
not be covered by Handbook 44.
PEI will be part of this effort and will monitor the progress of the
workgroup as it moves through the process.
PEI ELECTIONS COMPLETED; HAFER, WOOFTER AND WIEGERT ELECTED
Runoff elections have been completed in PEI Distributor Districts 2 and
4, and in the Affiliate Division. The three newly-elected directors,
together with four directors elected earlier, will join eight incumbent
directors on the PEI Board of Directors. The seven new directors will be
installed October 7 as members of the PEI board during the association's
membership meeting and brunch at PEI's convention in Atlanta. The three

COMMITTEE MEMBERS SOUGHT FOR FBO FUELING SYSTEMS RECOMMENDED PRACTICE
The PEI Board of Directors has authorized staff to develop a new
technical publication entitled Recommended Practices for the Design,
Installation, Service, Repair, Maintenance and Decommissioning of Fixed Base
Operator (FBO) Fueling Systems (RP1300). PEI is soliciting individuals who
are qualified and would like to serve on the committee responsible for writing this new
technical publication. The project is expected to take 12 to 18 months to
complete. The scope of the document will extend to both general aviation and
private fueling systems at airports. The publication will not cover hydrant
systems.
All members of the committee will be expected to attend three two-day
meetings over an 18-month period, beginning sometime next year. While
committee members pay their own travel expenses, PEI pays for the meals
during the meetings. Only individuals having relevant experience with FBO
fuel system design, installation, repair, maintenance or decommissioning
should apply. Members interested in serving on this committee should contact

volunteer or learn more. All interested parties should include a brief
statement describing why they are interested and their experience with this
equipment. Deadline is August 31. All appointments to the committee will be made by 2010 PEI
President Peter Ward.

Tanknology Inc., Austin, Texas, has licensed INTERPET, Istanbul, Turkey,
to offer the company's testing services to customers throughout Turkey.
J.A. Bourque and Sons Company, Manchester, New Hampshire, has been
ordered by a state court to drain its aboveground petroleum storage tanks until secondary
containment is installed.
The United States has settled alleged violations of federal and state
underground storage tank regulations at 17 gas stations in Delaware and
Maryland formerly owned by Duncan Petroleum Corp., the Justice Department,
Environmental Protection Agency and U.S. Attorney's Office for the District
of Delaware announced last week. Robert Duncan has agreed to pay a $2 million
civil penalty in this settlement.
