Dear PEI Member:

The federal EPA has been in the process of revising its underground storage tank (UST) regulations for a little more than two years. At the beginning of the process EPA solicited ideas from a variety of stakeholders, including PEI, and considered over 250 possible changes to the regulations.

In June of 2009, EPA shared a "Short List" of those issues the Agency planned to evaluate further (see July 2, 2009 TL). After considering the costs, benefits and technical feasibility of the possible changes, EPA has revised the Short List, which is shown word for word below.

This is the current list of issues EPA plans to continue to move through the EPA regulatory process. EPA says that while the list reflects the current thinking for potential changes to the UST regulations, the "list may change further as it navigates the regulatory process." The Agency hopes to publish a proposed rule in the Federal Register for public comment in the winter of 2010. 

EPA SHORT LIST

RELEASE PREVENTION

  • Operation and maintenance (O&M)Includes overfill functionality testing, walk through checks, spill bucket testing and integrity testing for interstitial areas.
  • Ball floats Eliminate flow restrictors in vent lines as overfill device on new systems and when overfill is replaced.
  • Address repairs:
  • Repairs and secondary containment If primary or secondary wall is fixed, must verify structural integrity of interstitial space before returning tank/piping to service.

  • Revise repairs section to include non-release repairs and include requirements testing. This will require also re-evaluating repair definition and disassociating repair from release.

RELEASE DETECTION
  • O&M Walk through checks and periodic operational checks and periodic testing (automatic tank gauge, probes, sensors, line leak detectors and alarms).
  • Incorporate new technologies with applicable performance standards Statistical Inventory Reconciliation (SIR), Continuous In-Tank Leak Detection System (CITLDS).
  • Address interstitial alarms with regard to section 280.50 "Reporting of Suspected Releases."
  • Phase out groundwater and vapor monitoring as leak detection methods.

OTHER

  • Update regulations to acknowledge 1998 deadline has passed.
  • Require closure of lined USTs that fail periodic inspection and cannot be repaired.
  • Update tank, piping sections for new technologies Include clad and jacketed tanks, flexpiping.
  • Notification of ownership changes Require revised notification forms when ownership changes at the facility.
  • Technical corrections such as update standards and correct typos.
  • Address alternative fuels and compatibility.

 DEFERRALS

  • Exclude USTs containing radioactive substances.
  • Exclude emergency generator USTs at nuclear power generation facilities regulated by NRC.
  • Fully regulate emergency generator USTs.
  • Regulate airport hydrant systems with alternate release detection requirements.
  • Regulate field-constructed USTs with alternate release detection requirements.
  • Regulate wastewater treatment tanks.

PEI BOARD ELECTION DEADLINE
It is time to begin the process of electing members to the PEI Board of Directors. Under PEI's election procedure, the official representative or a duly appointed alternate must request to have his/her name included on the ballot. A form for that purpose was sent May 24 to the official representatives of PEI member companies from the even-numbered districts of PEI's distributor and manufacturer divisions and PEI's affiliate division. The form must be received in Tulsa by the close of business on Thursday, June 10, for the name to appear on the ballot. FIVE CHARLES D. KEMP SCHOLARSHIP RECIPIENTS NAMED
The PEI Foundation's scholarship selection committee has selected five entering college freshmen to receive the inaugural Charles D. Kemp scholarships. Recipients of the $1,000 scholarships are:

NEW ULSD DISPENSER LABEL REQUIREMENTS CLARIFIED
Effective June 1, 2010, all nonroad diesel was reduced at the refinery level from 500 parts per million (ppm) sulfur to 15 ppm. Locomotive and marine diesel fuel was reduced to 500 ppm. In many states, the same 15 ppm cap will apply to locomotive and marine diesel fuel beginning in June, 2012. In non-NEMA (Northeast/Mid-Atlantic) areas, 500-ppm nonroad diesel will be allowed until 2014. EPA's ULSD regulations do not apply in California and Alaska.

There has been some confusion with regard to the labeling requirements for diesel fuel dispensers in 2010. EPA has written a letter to API acknowledging ambiguities in its rule and approving alternative diesel fuel pump labels and alternative kerosene pump labels for use by all retail and wholesale purchaser-consumer facilities. CHINA TO LAUNCH ETHANOL BY 2013
Novozymes A/S, a Denmark-based industrial enzymes producer, said May 28 that it expects China to launch its first commercial cellulosic ethanol facility by 2013. Novozymes signed an agreement to provide enzymes for a demonstration plant in China that will produce 3 million gallons of ethanol from corn stalks by the third quarter of 2011. In February, Novozymes announced a new enzyme capable of breaking down plant waste. It said biofuel using the new process would be competitive with ordinary gasoline and cost less than $2 per gallon. Amid food-security concerns, China banned all new facilities from using crops as a feedstock in 2007.
