There soon may be an amendment to the National Fire Protection Association's
(NFPA) Code for Motor Fuel Dispensing Facilities and Repair Garages
(NFPA 30A) that would make it easier―and legal―for
service station owners to dispense mid-level ethanol blends (E15) using
equipment that is not listed for E15 by a nationally-recognized testing
organization like Underwriters Laboratories. If approved, this action may
remove an impediment to the introduction and use of E15, a higher-blend
ethanol fuel that the federal government is expected to allow at least in
some vehicles this summer.The new language is
proposed as a Tentative Interim Amendment (TIA). It was published in the May
6, 2010, issue of NFPA News and creates a
new section 6.2.3 and 6.2.3.1 with
accompanying annex text. In essence, the proposed TIA provides the
authority having jurisdiction (AHJ) with the ability to approve for use with
mid-level alcohol blended motor fuels (i.e., E15) dispensing devices and
related dispensing equipment currently listed for use with E10. Approval by
the AHJ requires that the dispensing device and related dispensing equipment
be listed for use with E10 and that periodic inspections be conducted to
verify that the equipment is functioning properly. Hanging hardware is
required to be inspected at least weekly and the interior of the dispenser
to be inspected at least monthly. The TIA requires that documentation be
available for review by the AHJ upon request. The annex refers the code user
to the inspection forms found in PEI/RP500-05, Recommended Practices for
Inspection and Maintenance of Motor Fuel Dispensing Equipment, and
available at www.pei.org/rp500.
The proposed amendment is available for public
comment through June 18, 2010. Concurrent with the public review period, the
NFPA 30A technical committee is voting on both the technical merits of the
amendment and whether the amendment involves an issue of an emergency
nature. Public comments inconsistent with the vote of any technical
committee member are circulated to the committee to allow votes to be
changed.

Provided the requisite number of votes are received at
the technical committee level, the NFPA Standards Council will then consider
issuing of the TIA at its August 3-5, 2010, meeting. TIAs usually become
effective 20 days after the Standards Council approves the amendment.
EPA URGED TO DEFINE WIDESPREAD USE
The Massachusetts House of Representatives passed a resolution in March
calling on EPA to define "widespread use" of onboard vapor recovery (ORVR)
systems on automobiles. The Independent Oil Marketers Association of New
England has forwarded that resolution to Congressman Ed Markey, seeking his
assistance in urging EPA to define the term. Federal regulations state that
once ORVR is in widespread use, Stage II vapor recovery may no longer be
required, and state and local air quality control agencies may begin a
process to permit gasoline-dispensing facilities to discontinue the use of
Stage II systems.
CHARLES D. KEMP GOLF TOURNAMENT A SUCCESS
The inaugural PEI Foundation Golf Tournament was held April 29, 2010, in
Houston, Texas. Sixty-three golfers and 43 corporate sponsors enjoyed the
scramble-format tournament, a casual lunch and barbeque dinner. The
tournament and accompanying auction netted more than $25,000 to help fund
the Foundation's Charles D. Kemp scholarships―awarded
to deserving dependents of PEI member company employees. Auction items
included golfing memorabilia autographed by Arnold Palmer, Ben Hogan, Payne
Stewart, Gene Sarazen and Byron Nelson; Southwest Airlines "fly-anywhere"
tickets; hunting and fishing trips; and registrations to the 2010 PEI
Convention at the NACS Show. Members of the winning tournament foursome
were: Joey Batchelor, Guardian Fueling Technologies; Mike Frisk, Franklin
Fueling Systems; Luke Clements, Petroleum Solutions, Inc.; and Steve Moore,
CROMPCO. Recipients of the Charles D. Kemp Scholarships for the 2010-11
academic year will be announced May 15.
BRIEFLY NOTED
Shields, Harper & Co., Inc. has moved its headquarters to a new location
at 4591 Pacheco Blvd., Martinez, CA 94553. The new office provides more
office and warehouse space for the company. All phone numbers remain the
same.
Daimler Trucks North America has already received 10,000 orders for
vehicles equipped with selective catalytic reduction (SCR) technology, which
requires diesel exhaust fluid to reduce NOx emissions.
Caltex Australia will scrap plans to buy 302 Mobil service
stations after weighing its options following opposition from the Australian
Competition and Consumer Commission (ACCC) last December. The ACCC had said
the purchase would reduce competition in the wholesale supply and
distribution of gasoline in New South Wales and Queensland, and lead to
higher prices.
The Pantry, Cary, North Carolina, plans to sell off about 80
convenience stores in nine states in the coming months to independent
operators.
Jones & Frank, headquartered in Raleigh, North Carolina, has assigned
the duties of service director to Scott Jones, who will also remain as
executive vice president of the company.
DEATHS
Edgar (Ed) M. Beaver died April 16 at home in Charlotte, North Carolina.
He was 91. Following his service in the Army in World War II, Ed went into
business with his brother-in-law and brother at Southern Pump & Tank Company
in Charlotte. In 1956 he became president of Southern Pump & Tank and served
in that capacity until his retirement in 1984. He was one of the founders of
six different companies during his lifetime, including Bendel Corp.,
Equipment Associates and Shannon & Associates. Ed also served many years as
treasurer of PEI. He was predeceased by his wife of 55 years, Doris.
Survivors include his present wife, Elizabeth; a son, William; a daughter,
Patty Rocklage; and five grandchildren.
