The bill comes as EPA is considering a waiver request submitted earlier this
year by Growth Energy and other ethanol supporters to allow ethanol blends
up to 15 percent. EPA has until December 1 to rule on the request.
If this bill passes, even if EPA approves Growth Energy's waiver for E15 in
December, it would be more than a year before adequate testing on small engines
could be carried out and the required reports could be prepared.
Not surprisingly, the bill has the support of the Alliance of Automobile
Manufacturers and the National Petrochemical and Refiners Association, while
the ethanol industry believes the legislation is unnecessary.
Most industry insiders think this bill is dead on arrival, as they believe ethanol
proponents in the Senate will see to it that the bill goes nowhere. The bill

USTS NOT REGULATED UNDER 40 CFR 280
The federal EPA expects underground storage tanks containing
diesel exhaust fluid (DEF) will store, at the most, a minimal amount of
ammonia in the DEF and thus meet the de minimis exclusion under
section 280.10(b)(5). Accordingly, USTs containing DEF are not regulated as
hazardous substance USTs under the federal UST regulations. It is important
to note that some states may choose to be more stringent than federal
regulations and require DEF USTs to fully comply with state UST regulations.

A revised Gasoline Dispensing Facility Enhanced Vapor Recovery
Interactive CD is now available through the California Air Resources Board's
Compliance Assistance Program. The CD contains information on how the vapor
recovery systems work, the new EVR requirements, how EVR systems are
certified, how to inspect these facilities, and how these facilities are

Jennifer Rhoads has been named as the new president and CEO of the
Ohio Petroleum Marketers and Convenience Store Association. She succeeds
Roger Dreyer, who retired earlier this month. Rhoads has served as the
association's chief legal counsel since 1999.
Sunshine Gasoline Distributors, Doral, Florida, purchased 35
stations in Miami-Dade County, Florida, from Motiva Enterprises LLC.
Getty Realty Corp. announced September 25 it acquired 36 Exxon
branded gasoline stations and convenience stores located primarily in Prince
George's County, Maryland, for $49 million in a sale/leaseback transaction
with White Oak Petroleum LLC.
