A draft of PEI's newest publication Recommended Practices for the Storage and Dispensing of Diesel Exhaust Fluid  (PEI/RP1100) is now available for comment.

The document was prepared at the request of the SCR (Selective Catalytic Reduction) Stakeholder Group, which was concerned that the industry needed such a document before DEF was dispensed into new heavy-duty, diesel-powered highway engines and vehicles produced after January 1, 2010. PEI is the first trade group to publish a document covering this particular subject. 

The document was written to provide recommended practices for the installation and operation of DEF storage and dispensing equipment that will preserve DEF quality and prevent releases into the environment. The recommended practices in this publication apply to the storage, handling and dispensing of DEF at motor-fuel-dispensing facilities and repair and maintenance garages. It is limited to storage containers that use a pump and/or meter to dispense DEF.

The draft document and comment form are available at www.pei.org/RP1100. PEI accepts comments to its draft recommended practices from anyone with an interest in the subject. Online comments offering changes to the document will be accepted until October 30, 2009, to be considered by the PEI DEF Committee. The Committee hopes to publish a final document by the end of the year. 

BILL WOULD MANDATE SAB REVIEW OF HIGHER ETHANOL BLENDS
Senator Susan Collins (R-Maine) and three co-sponsors introduced a bill on September 14 requiring that "new gasoline fuel mixtures introduced into the marketplace be compatible with gasoline-fueled engines already in widespread use." It calls for EPA's Science Advisory Board (SAB) to study the compatibility of a new fuel blend with current engines before EPA certifies "an ethanol concentration above 10%." The bill, among other things, requires a written report that describes "the ability of wholesale and retail gasoline distribution infrastructure, including bulk storage, retail storage configurations, and retail equipment (including certification of equipment compatibility by independent organizations), to introduce the mid-level ethanol blend into commerce without widespread intentional or unintentional misfueling by consumers."

The bill comes as EPA is considering a waiver request submitted earlier this year by Growth Energy and other ethanol supporters to allow ethanol blends up to 15 percent. EPA has until December 1 to rule on the request.

If this bill passes, even if EPA approves Growth Energy's waiver for E15 in December, it would be more than a year before adequate testing on small engines could be carried out and the required reports could be prepared.
  
Not surprisingly, the bill has the support of the Alliance of Automobile Manufacturers and the National Petrochemical and Refiners Association, while the ethanol industry believes the legislation is unnecessary.

Most industry insiders think this bill is dead on arrival, as they believe ethanol proponents in the Senate will see to it that the bill goes nowhere. The bill was referred to the Senate Environment and Public Works Committee.

DEF USTS NOT REGULATED UNDER 40 CFR 280
The federal EPA expects underground storage tanks containing diesel exhaust fluid (DEF) will store, at the most, a minimal amount of ammonia in the DEF and thus meet the de minimis exclusion under section 280.10(b)(5). Accordingly, USTs containing DEF are not regulated as hazardous substance USTs under the federal UST regulations. It is important to note that some states may choose to be more stringent than federal regulations and require DEF USTs to fully comply with state UST regulations. NEW EVR PUBLICATION AVAILABLE FROM CARB
A revised Gasoline Dispensing Facility Enhanced Vapor Recovery Interactive CD is now available through the California Air Resources Board's Compliance Assistance Program. The CD contains information on how the vapor recovery systems work, the new EVR requirements, how EVR systems are certified, how to inspect these facilities, and how these facilities are tested. Jennifer Rhoads
has been named as the new president and CEO of the Ohio Petroleum Marketers and Convenience Store Association. She succeeds Roger Dreyer, who retired earlier this month. Rhoads has served as the association's chief legal counsel since 1999.
Sunshine Gasoline Distributors, Doral, Florida, purchased 35 stations in Miami-Dade County, Florida, from Motiva Enterprises LLC.
Getty Realty Corp. announced September 25 it acquired 36 Exxon branded gasoline stations and convenience stores located primarily in Prince George's County, Maryland, for $49 million in a sale/leaseback transaction with White Oak Petroleum LLC.
