Dear PEI Member:

On December 20, 2007, the Environmental Protection Agency (EPA) issued air toxics standards for smaller emitting sources, called area sources, that distribute and store gasoline, including bulk terminals and plants, pipeline facilities, and at gasoline dispensing facilities (GDF) where storage tanks are loaded. Although most facilities already comply with the final standards, EPA estimates that about 14,000 facilities will need additional controls. That number includes an estimated 20 terminals, 390 bulk plants, 400 pipeline breakout stations, 1,800 pipeline pumping stations, 1,600 cargo tanks, and 9,900 gasoline dispensing facilities. Compliance with the rules are expected to result in capital expenditures of approximately $75 million.

EPA's final rules require the following equipment and controls for terminals, bulk plants and pipeline facilities nationwide:

  • Specified floating roofs and seals or a closed vent system and control device for tanks with a capacity of 20,000 gallons or more. Tanks under 20,000 gallons must be covered.
  • Use of submerged fill pipes when loading storage tanks and cargo tanks at bulk plants and smaller terminals.
  • Vapor processors to control tank truck loadings at larger bulk terminals (above 250,000 gallons per day).
  • Leak testing of tank trucks and railcars.
  • Monthly sight, sound and smell inspection of all equipment components in gasoline liquid or vapor service.

All gasoline dispensing facilities (GDF) are covered by this rule. The rules require control of loading the storage tank only and reference the GDF's monthly gasoline throughput.

  • All GDF must perform specified good management practices to check for and minimize evaporation of gasoline.
  • All GDF with a throughput over 10,000 gallons per month must use submerged fill when loading their storage tanks. The submerged fill requirement is met by either bottom loading the storage tank or by using a fill pipe to load the storage tank that extends to no more than 12 inches from the bottom of the storage tank for fill pipes installed on or before November 9, 2006, and no more than 6 inches from the bottom of the tank for fill pipes installed after November 9, 2006.   
  • All GDF with a monthly throughput of 100,000 gallons or more must also use Stage I vapor recovery when filling their underground storage tanks.

The owner or operator of a new area source must comply with these final rules when they are published in the Federal Register (expected soon) or upon initial startup, whichever is later. The owner or operator of an existing area source must comply with all the requirements of these final rules within three years from the date of publication in the Federal Register. LARSON BECOMES PEI'S 58th PRESIDENT; APPOINTS COMMITTEES
Bruce F. Larson, president of The Oscar W. Larson Co., headquartered in Clarkston, Michigan, became the 58th president of the Petroleum Equipment Institute on January 1. He succeeds Calvin Bishop, president of D & H Pump Service, Inc., El Paso, Texas, in that post. Blair D. Shwedo, president of SouthEastern Petroleum Systems Inc., Charlotte, North Carolina, is PEI's vice president for 2008.

One of Larson's first duties was to appoint committees for 2008. In all, 142 people were named to serve on 17 PEI committees, and 16 individuals were appointed to a PEI committee for the first time.

We appreciate the willingness of all committee members to contribute their time and talents to serve the association and the industry. Many PEI committees welcome new members each year. 2008 CROSS-INDUSTRY DISTRIBUTOR COMPENSATION SURVEY
One of the major challenges that faces distributors is hiring good workers and then being able to keep those workers. Sometimes it takes more than just a competitive paycheck to attract good talent. Do you know how your firm's employee compensation package stacks up in today's industry? PEI distributors are fortunate to have access to a cross-industry survey to help them evaluate their compensation program. PEI is a co-sponsor for the 2008 Employee Compensation Study conducted by Profit Planning Group. Approximately 2,500 firms in over 35 distribution lines of trade are expected to participate. Your participation ensures a comprehensive report. As a participant, you will receive the report free of charge. Non-participants have the option of purchasing the results for $295. The deadline for submitting company compensation information is January 15.

EPA PROVIDES INFORMATION ON STATE DELIVERY PROHIBITION PROGRAMS
Delivery prohibition programs prohibit product delivery to underground storage tanks (USTs) that the state or territory has determined has one or more compliance violations. Thirty states and territories currently have such a program. About half of those have a red tag program that physically identifies USTs that are ineligible to receive product. The other half have a green tag program that physically identifies USTs that are eligible to receive product. Over 20 states and territories that do not have a red or green tag delivery prohibition program only have UST registration requirements.

EPA has established a state delivery prohibition web site at www.epa.gov/oust/dp. The site provides links to states' and territories' delivery prohibition programs where users will find detailed information, including applicable laws, regulations and policies. EPA hopes that the information accessible through this site will help fuel delivery drivers determine if an underground storage tank is not eligible to receive fuel.

A PowerPoint presentation on Enhanced Vapor Recovery made December 5 by Cindy Castronovo and Pat Bennett of the California Air Resources Board is available here. Although you don't have the benefit of listening to the presenters, the 67-slide presentation includes many images of vapor recovery equipment and provides an excellent overview of the California Enhanced Vapor Recovery program.

DEATHS
Richard "Rick" Lewis
, retired vice president of engineering and new product development for Western Fiberglass, died October 15 from complications during surgery. He was 59. Rick joined his brother Mike at Western Fiberglass in 1986 when the company was building airfoils and body parts for the professional race car industry. He began developing fiberglass equipment for the petroleum equipment industry in 1987. He retired in 2005 and devoted much of his time to fishing from his boat, the "Gray Eagle."
